Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Wescove website and lead-delivery service (the "Service"), operated by Wescove LLC ("Wescove," "we," "us," or "our"). By signing up for, purchasing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Wescove compiles publicly available business-registration records from the State of Florida and delivers filtered lists of newly registered businesses to subscribers. The Service is an informational tool. We do not provide legal, financial, insurance, or professional advice, and we are not affiliated with, endorsed by, or connected to any government agency.

2. No Guarantee of Results

We do not guarantee any specific outcome from use of the Service, including any number of clients, sales, appointments, or revenue. Lead data is provided for your independent evaluation and outreach. Results depend on your own efforts, market conditions, and many factors outside our control.

3. Data Accuracy

Lead data is sourced from third-party public records. While we take reasonable steps to clean and format it, we do not warrant that any record is accurate, complete, current, or fit for a particular purpose. You are responsible for verifying information before relying on it.

4. Your Responsibilities & Lawful Use

You are solely responsible for how you use the data and for complying with all applicable laws when contacting businesses or individuals, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state and federal Do-Not-Call rules, and any applicable telemarketing, email, fax, and data-privacy regulations. You agree to indemnify and hold Wescove harmless from any claims arising out of your use of the data or your outreach activities.

You agree not to: (a) resell, redistribute, or sublicense the data except as expressly permitted in writing; (b) use the Service for any unlawful, harassing, fraudulent, or deceptive purpose; (c) attempt to gain unauthorized access to the Service; or (d) use automated means to scrape or copy the Service beyond your subscription.

5. Subscriptions, Billing & Auto-Renewal

Paid plans are billed on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method automatically each billing period until you cancel. Prices may change with notice; changes apply to the next billing period. You are responsible for any applicable taxes.

6. Cancellation & Refunds

You may cancel at any time, and cancellation takes effect at the end of your current billing period. Fees already paid are non-refundable, including for partial billing periods. See our Refund & Cancellation Policy for details. A free sample is available before purchase so you can evaluate the Service.

7. Founding Member Agreement

Founding Member pricing is a limited promotional rate offered to a limited number of early subscribers, in exchange for marketing permissions. By claiming a Founding Member subscription, you agree to the following as a condition of the discounted rate:

(a) Name & logo license. You grant Wescove LLC a non-exclusive, royalty-free license to display your company name and logo, and to identify you as a Wescove founding member, on our website and in marketing materials, for as long as you remain a customer and for a reasonable period thereafter. You represent that you are authorized to grant this license.

(b) Testimonial. You agree to provide a short written testimonial (one to three sentences) about your experience with Wescove within thirty (30) days of your start date, which Wescove may publish and attribute to you and your company.

(c) Rate. The founding rate applies for as long as your subscription remains continuously active. If you do not provide a testimonial within the period above, or if you cancel, Wescove may transition your subscription to standard pricing on renewal. The founding rate may no longer be available upon resubscription after cancellation.

Wescove will not fabricate, alter the meaning of, or misattribute any testimonial, and will remove your name, logo, or quote within a reasonable time upon written request.

8. Intellectual Property

The Service, including its software, design, compilations, and branding, is owned by Wescove LLC and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service and the data you receive for your own internal business-development purposes.

9. Disclaimer of Warranties

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WESCOVE LLC AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Wescove LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your outreach activities, or your violation of these Terms or any law.

12. Termination

We may suspend or terminate your access if you violate these Terms or misuse the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive (including Sections 4, 9, 10, and 11) will survive.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date. Continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
